Was erfasst wird

Erfasst wird eine Entscheidung, wenn sie auf einen Antrag auf Kostenentscheidung nach Regel 151 VerfO die erstattungsfähigen Kosten festsetzt, also im gesonderten Verfahren der Regeln 150 bis 157 VerfO. Entscheidungen, die einen solchen Antrag zurückweisen, werden nicht erfasst. Ebenso wenig Kosten, die außerhalb dieses Verfahrens festgesetzt werden, etwa von den Parteien vereinbarte Beträge, die das Gericht in die Entscheidung in der Hauptsache aufnimmt, vorläufige Kostenerstattungen in Verfahren über einstweilige Maßnahmen und vom Gericht bestätigte Vergleiche.

Angezeigt wird die Obergrenze für das, was die Festsetzung umfasst, vor einer Quotelung bei teilweisem Obsiegen. Wo das Gericht sie nicht angibt, wird sie aus dem Streitwert oder aus den Obergrenzen mehrerer Instanzen oder Verfahren abgeleitet und als abgeleitet gekennzeichnet, mit ihrer Grundlage.

Neue Entscheidungen werden wöchentlich automatisch erfasst. Veröffentlicht wird eine Erfassung nur, wenn jeder darin genannte Betrag im Text der Entscheidung steht. Alles Übrige wird zur Prüfung zurückgehalten. Noch nicht von Hand geprüfte Erfassungen sind gekennzeichnet.

Einige Kostenentscheidungen sind selbst nicht veröffentlicht. Betrag und Obergrenze stammen dann aus den später veröffentlichten Anordnungen, die sie wiedergeben.
